Terms and Conditions

By creating an account with ChildFinda and its associated entities, or using the website www.childfinda.com or app “ChildFinda” or any other associated information, product or service; you agree to indemnify ChildFinda and its associated entities, Directors, partners, contractors and any other associated persons or entities harmless against any and all loss, cost, damage or other liability (including legal costs on a full indemnity basis) which they (the entities etc) may incur from or in connection with a claim by any third party arising from a breach by you of any Term.  They (entities etc) reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.

 

Indemnity

• By using our services or products or advice you agree to indemnify C Stream Pty Ltd and hold it harmless against any and all loss, cost, damage or other liability (including legal costs on a full indemnity basis) which C Stream Pty Ltd may incur from or in connection with a claim by any third party arising from a breach by you of any Term.  C Stream Pty Ltd reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.
• You expressly understand and agree that C Stream Pty Ltd shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if C Stream Pty Ltd has been advised on the possibility of such damages. Resulting from (i) the use or the inability to use the service (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through from the service: (iii) unauthorized access to or alternation of your transmissions or data: (iv) statements or conduct of any third party on this service: or (v) any other matter relating to the goods or service(s).

In plain language; we have created an application on the basis of helping child safety and parent’s peace of mind and have taken every reasonable precaution, we have thought of, to safeguard those children, you and others and require you to acknowledge this and indemnify us described above.

Limited Warranty, Disclaimer and Limit of Liability

 

In the event of software malfunction or not performing as described then you have a choice to unsubscribe from our product or service and close any or all accounts.  We do not warrant your data, that the Software will meet your requirements, or that the operation will be uninterrupted or error free.  No software is perfect and there are many variables that may affect the software or data service that are beyond or within the control of us.

 

THE WARRANTY ABOVE IS IN LIEU OF ALL OTHERS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES HAVE LAWS THAT MAY RESTRICT OR PROHIBIT THE LIMITATIONS SET FORTH ABOVE AND YOUR RIGHTS UNDER LAW MAY VARY ACCORDING TO THE LAWS OF YOUR STATE.

ChildFinda and its associated entities etc shall not be liable for any incidental or consequential damages, including loss of data, lost profits, cost of cover, or other special or indirect damages. Your rights under law may vary.

 

If you use any software from C Stream Pty Ltd you are agreeing to the terms of this Agreement.  Use of the Software is subject to this agreement. If you do not agree to the terms of this Agreement, at the time of initial use, then do not use the software.  

 

C Stream Pty Ltd grants you a non-exclusive right to use the Software and accompanying materials according to the following:

 

You May

• Use and install the software on any computer or other device that it runs on, and
• Transfer the software from one computer or device to another

You May Not

• Modify, reverse engineer, or copy (except for a backup copy) the software or accompanying materials; or
• Rent or transfer the title of the Software
• This license is not a sale. Title and copyrights to the Software and accompanying materials remains with C Stream Pty Ltd and its licensors.  Any breach terminates this Agreement.

Governing Law and Jurisdiction

The law of Queensland, Australia governs this agreement.
